School to receive sensitivity training after lesbian kicked out of gym class
Court ruling requires training and updating of anti-discrimination policy

LOS ANGELES (AP) — Teachers and students in the Banning Unified School District will receive sensitivity training under terms of a legal settlement with a student who claimed she was kicked out of her gym class because she is a lesbian.
The American Civil Liberties Union (ACLU) of Southern California filed suit on behalf of Ashly Massey.
Massey, a 15-year-old eighth-grader at the time, says she was forced to sit outside of her principal’s office during her gym class for a week and half in March 2002 because of her sexual orientation.
In addition to updating its anti-discrimination policy to reflect state law the school district agreed to train staff members on issues of anti-discrimination and provide educational programs on diversity to students of all grade levels, said ACLU attorney Martha Matthews.
The school district and other individual defendants named in the suit denied any wrongdoing or liability in the settlement of the suit, filed in Los Angeles federal court. The agreement also says all defendants continue to dispute the facts of the case.
Banning Unified agreed to pay Massey, now 16 years old and attending Palm Desert High School in Coachella Valley, $45,000. A third of that money will go to legal expenses.
