BOSTON (AP) – Gov. Mitt Romney, in a renewed bid to block out-of-state gay and lesbian couples from marrying in Massachusetts, plans to send letters to all governors and attorneys general asking if gay and lesbian couples can marry in their states.
Unless he hears back that same-sex marriage is allowed – something it is unlikely any state outside of Massachusetts can claim – Romney said he will tell clerks in Massachusetts to bar those couples from marrying here.
“Massachusetts should not become the Las Vegas of same-sex marriage,” Romney told The New York Times. “We do not intend to export our marriage confusion to the entire nation.”
Romney said he also ordered changes to the state’s marriage application, replacing “bride” and “groom” with “Party A” and “Party B.”
The new form adds questions not on the original form, including whether those applying for marriage were previously joined in a civil union or domestic partnership, and whether those unions were dissolved.
The new form also asks for “evidence of where a person resides and intends to continue to reside” including a utility bill, automobile registration or real estate documents. The form warns out-of-state couples that if they do not intend to move to Massachusetts, the marriage “shall be null and void.”
Despite its tough language, the form gives city and town clerks the final say in deciding how stringent to be and whether to issue a license. The clerks must sign the license indicating they are “satisfied with the documentary evidence presented.”
Romney is basing his decision on a 1913 Massachusetts law that says the state cannot marry out-of-state couples if their marriage would be “void” in their home state.
Opponents of same-sex marriage, including Romney and state Attorney General Thomas Really, have pointed to the law in an effort to discourage out-of-state couples from traveling to Massachusetts to marry.
