Lesbian couple settles discrimination suit against country club
Country club now extends membership benefits to registered domestic partners

SAN DIEGO (AP) – A lesbian couple that won a landmark state Supreme Court anti-discrimination ruling against their local country club has agreed to settle the case, according to court documents.
The terms of the settlement, reached earlier this month, are confidential, the couple’s attorney, Paul Kondrick, said Tuesday.
Birgit Koebke, an avid golfer, sued the Bernardo Heights Country Club in 2001 after being told that couples registered as domestic partners didn’t qualify for the same discounts given to married couples.
The couple’s suit claimed that the policy violated state law and discriminated against members based on their sexual orientation and marital status. Under state law, the pair cannot marry.
In August 2005, the state Supreme Court overturned a San Diego judge’s pretrial ruling in favor of the country club, saying in its opinion that the policy constitutes “impermissible marital status discrimination” under the state’s sweeping domestic partner law, which took effect at the beginning of that year.
The club changed its membership policy after the Supreme Court ruling and now extends membership benefits to registered domestic partners, said club membership director Ralph McMillan.
The suit had been scheduled for a February trial in San Diego Superior Court.
