Man ordered to trial in murder near Ralph’s
Suspect pleads not guilty
Published Thursday, 21-Aug-2008 in issue 1078
A homeless man admitted to police he stabbed and killed another man out of “frustration” in an ongoing dispute.
Richard Kenneth Sherman, 30, was ordered to stand trial Aug. 14 for murder in the slaying of Manuel Santiago, 25, who was found lying on the sidewalk July 3 in front of the Great Earth Vitamin Store next to Ralphs in the Uptown District Shopping Center.
A Ralphs manager found Santiago around 2:30 a.m. The victim was taken by ambulance to a hospital where he died 30 minutes later.
Both Sherman and Santiago were homeless but stayed with friends or acquaintances when they could, said Sherman’s attorney, Vic Eriksen.
Steven Graham, a bouncer at the San Diego Sports Club bar on University Ave., testified that another employee broke up a fight between Sherman and Santiago earlier that evening. He said the fight was mismatched because Sherman was much bigger than Santiago, the latter standing 5-foot 3 inches.
“I’ve seen both these individuals in fights before,” said Graham, who said he did not know what the ongoing dispute was about.
Graham told San Diego Superior Court Judge John Thompson he had seen Sherman playing with a knife in the past and noted that “he was a little more aggressive than usual” that night. Sherman was also drunk, he said.
San Diego Police Detective Michael Lambert testified that Sherman admitted to stabbing Santiago once in the chest, and that he had fought with him before. He said Sherman told him he disposed of the murder weapon, a folding knife, in a canyon.
Sherman said he stabbed Santiago “out of frustration” after Santiago kept insisting his skateboard was missing or had been stolen, Lambert said. He denied he stabbed the victim in anger. During the first part of the interview, Sherman denied knowing Santiago.
After his interview, Sherman wrote a letter of apology to the victim’s family.
As the preliminary hearing concluded, Thompson ordered him to stand trial for murder and set a trial date for Nov. 3. Sherman pleaded not guilty. He remains in the George F. Bailey Detention Facility on $1 million bail.
