A gay man, who took a huge dose of LSD and injured his roommate by hitting him over the head with a 12-inch glass penis after setting his house on fire while nude, has been ordered to do 20 days of public service work under terms of three years probation.

The 24-year-old defendant is referred to as Jason in this story and is not identified because he is in the military. He said he fears he could be discharged because of the “don’t ask, don’t tell” policy. San Diego Superior Court Judge Kathleen Lewis gave a 270-day suspended jail term to Jason last month and gave him credit for eight days previously spent in jail.

Jason took a large amount of LSD at a New Year’s Eve party at his home in City Heights and began acting strangely. He stabbed the stove and then himself, according to court records. He struck his friend Michael, 28, over the head with the glass penis, and Michael went to the emergency room for treatment.

Before any violent act occurred, some of the party guests noticed he was acting strangely and removed his firearms from his room as a precaution. Several suspected Jason was acting suicidal.

After his friend left for the emergency room, Jason set the house on fire with the gas stove around 2:30 a.m. and took off all his clothes. He was bloody from his own wounds. San Diego Police officers found Jason outside but he resisted arrest. Officers used a bean bag gun, a taser, and the non-lethal weapons had no noticeable effect on him.

A police dog was used and it bit Jason, who then was overpowered by officers. He was taken to a hospital and then booked into jail on Jan. 1. He was charged with assault with a deadly weapon, which was the glass penis, arson, and resisting arrest.

He pleaded guilty to felony assault and the other charges were dropped. He was fined $1,214, and ordered to pay $1,127 in probation costs. He was ordered to complete a substance abuse program.

Lewis did not bar Jason from seeing his former roommate, but she wrote that Jason was barred from having “negative contact or unlawful contact” with the victim. Michael wrote a letter to the judge saying Jason “is not a threat to me.”

Though they are no longer roommates, Michael wrote that he has visited Jason and there were no problems. It is a testament to their friendship that Michael wrote favorably to the court.

The fire caused $30,000 in damages to the house, but it was covered by Jason’s rental insurance, according to his probation report. He had no prior record.
