A gay man accused of slashing his ex-boyfriend’s face with a knife was ordered Monday to stand trial for assault with a deadly weapon.
Amier Rocky Issa, 30, of Pacific Beach, was identified by his ex boyfriend as the person who slashed his face in a July 11 incident in Hillcrest. The victim was the sole witness at the preliminary hearing conducted by San Diego Superior Court Judge John Einhorn.
Deputy District Attorney Teresa Santana told the judge she plans to file an additional charge of making a criminal threat to the victim.
Issa was ordered to appear in court on Oct. 8 for arraignment and setting of a trial date.
Issa has denied the charge and has pleaded not guilty. According to the questions posed by his attorney, Arthur Greenspan, the victim may have been cut by a bent paper clip that held Issa’s broken watch together. The victim said he was sure it was a knife.
The victim, a waiter, left the restaurant he worked for around 8:30 p.m. He testified he saw Issa drive near him in the 1200 block of Essex Street while the victim was walking home.
The Gay & Lesbian Times does not identify victims of domestic violence or sexual assault.
“He confronted me. He was angry and upset. He was accusing me of cheating on him,” the victim said. “I dated him for 11 months … He pulled a knife out of his picket. The next thing I know my face was cut open.
“I didn’t think he would hurt me. I didn’t run away until he swung the blade. I was afraid. He was chasing me afterwards. I did look back. I wanted to see if I was running fast enough.”
Greenspan accused the victim of breaking Issa’s watch, which he said was held together by a bent paper clip. Greenspan pulled out a watch and described how he said the victim had broken it, but the victim denied it.
“It was already broken before,” he said. “I am 100 percent sure I didn’t break the watch. He was angry and obviously upset.”
The victim said Issa is left handed, but testified he saw Issa pull out a four-inch Swiss Army knife with his right hand. He said the knife later was held in Issa’s left hand, but he didn’t see him switch it to his left hand.
Einhorn told Issa there is a protective order in place that restricts him from contacting the victim or be within 100 yards of him.
Issa remains free on $80,000 bond.
