Killer gets two life terms without parole
Motive for murder was burglary

The convicted killer of an openly gay caretaker and another man was sentenced to two consecutive life terms in prison without the possibility of parole and was ordered to pay for one victim’s funeral.
Samuel Joseph Graham III, 26, was transferred last week to a state prison to start his sentence for killing Rock Walker, 51, and his friend, Daniel Collins, 50, during a burglary on April 18, 2007. Walker was openly gay and was a caretaker for a 70-year-old man who was in the hospital at the time.
Because the state’s victim compensation program paid for one victim’s funeral, Graham was ordered to pay $5,346.29 to that program by San Diego Superior Court Judge Bernard Revak on Oct. 31. Revak also fined Graham $10,100, and ordered him to pay $10,000 in damages to the ransacked home of Frank Bernick, where Walker and Collins were found stabbed to death.
Deputy District Attorney Allen Brown said it’s not certain how Graham met Walker, but he said both had used Teligence, a social networking phone line that features gay dating. Graham is straight, but Brown said both Graham and Walker had used the Teligence features before they met.
Investigators found Graham’s bare footprint in the victim’s bathroom and his palm print on Walker’s bedroom door, said Brown. Walker was wearing only a shirt and had been stabbed from seven to nine times in the back, said the prosecutor.
Walker lived with Bernick, the 70-year-old man he was caring for, in a duplex in the 300 block of Woodman Street near Skyline Drive. Brown said the evidence indicates that Graham killed Walker first, and Collins apparently came by and was stabbed nine times in the back.
The motive for the slayings is apparently robbery. The 70-year-old man’s computer, safe, television, DVDs, and van were stolen. The van was found abandoned in Encinitas.
A jury on Aug. 6 convicted Graham of two counts of first-degree murder, with the special circumstance of committing multiple murders. They also convicted him of robbing the two victims, and burglary after five days of deliberations.
