A City Heights man who strangled a gay acquaintance after claiming he came on to him was sentenced Monday to 11 years in state prison.
Jorge Luis Munoz, 24, said nothing before San Diego Superior Court Judge David Danielsen denied probation and gave him 11 years for killing Pedro Ramirez, 37, in May, 2009. Ramirez was found dead on his own bed in his 38th Street apartment on May 29 by friends who forced open his locked bedroom door.
Danielsen ordered Munoz to pay $7,360 to the crime victim’s compensation fund which paid for Ramirez’s funeral. He also fined him $2,260 and gave him credit for 320 days already spent in jail including time off for good behavior.
Munoz pleaded guilty to voluntary manslaughter on Feb. 3, and a murder charge was dismissed. Munoz agreed to accept the 11 year term in a plea agreement with the District Attorney’s office. The prosecutor and defense attorney submitted the sentencing without argument since the sentence had already been agreed upon.
Ramirez worked at a restaurant in Little Italy while Munoz worked at the Cheesecake Factory Restaurant in Fashion Valley before his arrest.
Munoz also went by the nickname “Shaggy.”
Munoz wouldn’t talk with a probation officer who was preparing a sentencing report, said Deputy District Attorney Dan Link. On a court document, Munoz wrote the following: “I unlawfully killed another person without malice while in the heat of passion.”
Munoz insisted he was straight and told police he had a 15-year-old girlfriend. But a detective who testified at the Sept. 18 preliminary hearing said she interviewed several friends of the victim and they said Munoz was like a boyfriend to him.
Munoz changed his story to police during a 4-hour taped interview that started with his denial of harming Ramirez. He later said Ramirez “molested” him, kissed him, and threw him down on the bed. Munoz admitted he used his forearm around Ramirez’s neck to strangle him.
Munoz also told police he had sex with Ramirez once about four months earlier, but insisted he was not gay.
