Charged with sexual assault of sailor

After a City Heights man was ordered to stand trial for murder and sodomy of an intoxicated person, prosecutors said they will be adding more charges against the man they describe as a predator who took advantage of young, drunk men and drugged them before they were sexually assaulted.
The preliminary hearing of Philong N. Huynh, 39, ended March 5 and San Diego Superior Court Judge Charles Rogers ordered Huynh held to answer for the 2008 murder of Dane Williams, 23, and sexual assault of a 21-year-old sailor on June 6, 2009.
The sailor testified Dec. 17 and identified Huynh as the man who gave him some pills he thought were Tylenol but had a much different effect on him. The sailor said he blacked out at Huynh’s apartment, and noticed his underwear was missing although he was still mostly clothed.
The sailor eventually discovered he had been sexually assaulted and he underwent medical exams at Camp Pendleton. The sailor is currently stationed in Iraq and testified Dec. 17 because he could not testify in March.
Williams’ body was found in an alley about 800 feet from where Huynh lived. Williams was from Huntington Beach and was last seen intoxicated in the Gaslamp Quarter on Jan. 26, 2008. His fully clothed body(minus his underwear) was found three days later. His parents put up posters of their blond-haired son seeking information about what happened to him.
A police criminalist, Sean Soriano, testified he found a single sperm cell in Williams’ mouth and eight sperm cells were discovered on an anal swab of the victim. A DNA test was performed by another criminalist, David Cornacchia.
“That profile matched Philong Huynh,” said Cornacchia.
Williams was found wearing a knit cap that did not belong to him.
Cornacchia testified Huynh’s DNA was found on the cap. He also said Huynh’s sperm was found on Williams’ shirt.
Cornacchia also said that swabs of the sailor’s scrotum and anus were taken and they matched Huynh’s DNA. The criminalist said a hair found in Williams’ shoe matched the defendant’s hair. One sperm cell was found on dental floss, but it was not enough to test for DNA.
On cross examination with Huynh’s attorney, Terrie Zimmerman, Cornacchia said he could not determine when or how Huynh’s DNA got on to the items he tested.
District Attorney investigator Ken Brown testified he spoke with Williams’ longtime girlfriend. “She did not think (Williams) was gay,” said Brown.
San Diego Police detective William Pettus testified officers found 58 names of men with their description, phone numbers, and addresses in a file in Huynh’s room. Pettus said he phoned some of the men and several recalled meeting with an Asian man whom they drank with and later passed out.
Two men expressed puzzlement about how they met with Huynh and thought they had been drugged. One Marine at Camp Pendleton told Pettus he recalled being drunk in 2002 and an Asian man offered to give him a ride back to the base. However, the Marine discovered the man had taken him to Tijuana and he ended up in some strip club that had rooms with mattresses.
Pettus testified the Marine identified Huynh as the man who took him there. The Marine told Pettus that he “got freaked out” after seeing the rooms with mattresses and fled, finding his own way home.
Pettus interviewed another man who was in town from San Francisco on a convention and met an Asian man whom he identified in a photo lineup as Huynh. The San Francisco man recalled being drunk, and lost his wallet and cell phone after going somewhere with Huynh, Pettus said.
A deputy medical examiner testified he and other pathologists could not determine what caused Williams’ death. He said Williams had injuries to his chin and buttocks, but there was “no obvious cause of death.”
Deputy District Attorney David Hendren said he intends to add charges involving oral copulation of the two victims while they were unconscious. Huynh is also charged with the special circumstance of murder during sodomy. If convicted of first-degree murder, Huynh could be sentenced to life in prison without the possibility of parole.
A trial date will be set on March 18 and Huynh has pleaded not guilty. He remains in the George Bailey Detention Facility without bail.
