Man convicted of stabbing passenger on trolley sentenced to nine years
Published Thursday, 26-Apr-2007 in issue 1009
A San Diego Superior Court Judge has sentenced Exodus Bolton, 36, to nine years in state prison, for stabbing a man who came to the aid of a gay teen whom Bolton verbally and physically assaulted while riding the San Diego Trolley.
On April 16, Judge Frank Brown gave Bolton the maximum sentence and ordered him to pay $8,920.60 in medical payments to Victor Mendoza, 50, whom Bolton stabbed in the arm, Oct. 17, because he came to the aid of the teenager.
Upon hearing the sentence, Bolton erupted with a string of choice words for the judge.
“I don’t deserve that man. Fuck you guys! Prison is for animals! I’m not no fag. I’ll never be one. I’m not no pussy. I’m black, that’s my sin,” he yelled.
Bolton had acted as his own attorney when a jury, on Feb. 2, found him guilty of assault with a deadly weapon, mayhem, two misdemeanor battery charges and resisting arrest.
According to court records, when a passenger accidentally bumped into Bolton’s girlfriend on the trolley, Bolton blamed Rey Harris, 17, and let loose a string of anti-gay epithets. Harris confirmed he was gay, whereupon Bolton punched him and knocked him to the floor. When Mendoza came to the teenager’s defense, Bolton stabbed him several times in the arm. Bolton was also convicted of assaulting a female passenger and a young man who came to her aid three days earlier.
“I’m getting nine years for being attacked,” said Bolton, who had claimed self-defense.
“There is no right to self-defense in this case,” the judge responded. And, referring to Bolton’s string of epithets about many other groups, he added, “This is America. We have to savor the diversity.”
Bolton hired an attorney, Gary Brown, for sentencing. He unsuccessfully sought a new trial.
“I agree with the jury’s verdict, and I will deny your motion for a new trial,” said the judge to Bolton. “What you did was just outrageous.”
Before he left the courtroom, Bolton shouted to his mother in the audience: “I love you, Mama. Keep me in your prayers. God is my keeper.”
Brown gave Bolton credit for the last six months he spent in jail. Bolton was originally charged with a hate crime in the incident with the gay teenager, but another judge dismissed it in light of his laundry list of epithets of others.
